1. Agreement to Terms

By accessing or using Estately's website (www.estately.uk), application (app.estately.uk), API (api.estately.uk), and associated integrations including the Estately.uk app on TikTok, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

Estately is a project of Ether Corporation, registered at Quay House, Lansdowne Road, Torquay, TQ2 5BS.

2. Description of Service

Estately is a property auction intelligence platform that provides AI-powered analysis of UK property auction lots, including deal ratings, financial analysis, renovation cost estimates, and investment strategy tools. Estately also operates the Estately.uk app, which enables the creation and publishing of property video content to social media platforms including TikTok.

The service displays a combination of original analysis produced by Ether Corporation, data licensed from third-party partners, content sourced from auction houses and other property data providers, and information drawn from public datasets such as HM Land Registry, the Office for National Statistics, Police.uk, and the EPC Register.

Our service is provided for informational purposes only. We do not provide financial, investment, or legal advice.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activities that occur under it. Sharing accounts, transferring accounts to third parties, or allowing others to use your credentials is not permitted.

4. Subscriptions & Payments

Estately offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually through Stripe. By subscribing to a paid plan, you authorise us to charge your chosen payment method.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose, or in violation of any UK or international law or regulation
  • Use the service in any way that infringes the rights of Ether Corporation, our partners, our auction house data sources, or any third party
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code, algorithms, methods, models, or training data behind any part of the service
  • Use the service to develop, train, or improve any product, service, model, or dataset that competes with Estately
  • Resell, redistribute, sublicense, publish, or otherwise commercially exploit any data, content, analysis, or other material obtained from the service, whether in whole or in substantial part, without prior written permission from Ether Corporation
  • Bulk download, harvest, or otherwise extract substantial portions of the service's content, database, or any subset of it
  • Bypass, disable, or otherwise interfere with any security or access control feature of the service, including rate limits, authentication requirements, IP restrictions, robots.txt directives, geo-blocks, or paywalls
  • Interfere with, disrupt, or place an unreasonable load on the service or any associated infrastructure
  • Create multiple accounts, share accounts, or transfer accounts to circumvent free trial limits, paywalls, fair use policies, or other restrictions
  • Provide false or misleading information when registering for the service, or impersonate another person or organisation

Violation of any of these provisions may result in immediate suspension or termination of your account, forfeiture of any subscription fees paid, and may give rise to civil or criminal liability.

6. Automated Access, Scraping & AI Training

The Estately website (www.estately.uk), application (app.estately.uk), and API (api.estately.uk) are intended for human use through standard web browsers, mobile devices, and authorised API integrations. You agree that you will not, and will not permit, encourage, or assist any third party to:

  • Access, query, or interact with the service using any automated means including but not limited to bots, robots, spiders, scrapers, crawlers, screen-scrapers, headless browsers, automation frameworks, scripts, software agents, or any device that retrieves, indexes, processes, or extracts content from the service, except via the official authorised API where access has been explicitly granted by Ether Corporation
  • Use, reproduce, store, copy, or process any content, data, or material from the service to develop, train, fine-tune, evaluate, validate, benchmark, or improve any artificial intelligence model, machine learning model, large language model, generative model, or any similar system, whether for commercial or non-commercial purposes
  • Cache, mirror, archive, or store any substantial portion of the service's content or data offline, except for transient caching strictly necessary for normal personal browsing
  • Circumvent or attempt to circumvent any technical measure used to protect the service, including authentication, rate limits, CAPTCHA, IP blocks, geo-blocks, cookie requirements, robots.txt directives, or any other access control

These restrictions apply regardless of whether the data being accessed is content created by Estately, data provided by our partners, content sourced from auction houses, or facts originally drawn from third parties. The aggregation, curation, analysis, structure, and presentation of data on the service is itself protected, in addition to the underlying content.

Unauthorised automated access, or access in excess of the permission granted to you, may constitute an offence under the Computer Misuse Act 1990. Ether Corporation reserves the right to identify, block, and pursue legal action against any party engaged in such activity, including recovering damages, costs, and legal fees.

7. API Access & Use

The Estately API at api.estately.uk is available only to authorised partners and customers who have been granted explicit access by Ether Corporation. By accessing or using the API, you agree to the following additional terms, which apply alongside the rest of these Terms of Service:

  • You must use a valid API key issued to you by Ether Corporation. Sharing, reselling, transferring, or publishing API keys is strictly prohibited.
  • API access is subject to rate limits, fair use policies, and quota allocations communicated to you at the time access is granted. Exceeding these limits may result in throttling, temporary suspension, or permanent termination of access without notice.
  • All data returned by the API is subject to the same restrictions as data on the website and application, including the prohibitions on resale, redistribution, AI or machine learning training, bulk extraction, and onward sharing set out in Sections 5 and 6 of these Terms.
  • API responses may not be cached, stored, indexed, or republished beyond the period and purpose strictly necessary for your authorised use case. Persistent storage, redistribution, or republication of API data requires a separate written licence agreement with Ether Corporation.
  • You may not use the API to build, populate, or augment any product, service, dataset, or model that competes with Estately or that resells Estately data or partner data in any form.
  • Ether Corporation may revoke API access at any time, with or without cause, including in cases of suspected misuse, security risk, infringement of partner rights, or violation of these Terms.
  • You are responsible for keeping your API credentials secure. You must notify Ether Corporation immediately at [email protected] if you believe your credentials have been compromised.
  • Any commercial use of API data, including incorporation into a product or service offered to third parties, must be agreed in writing in advance through a separate licence agreement.

The API is provided "as is" without warranties of any kind. Ether Corporation accepts no liability for service interruptions, data inaccuracies, or downstream effects of API use.

8. Uploaded Documents

When you upload legal pack documents for analysis, we process them to provide you with a structured risk assessment. We may also extract factual data (such as costs, charges, and dates) to improve the accuracy of property financial calculations displayed on the platform.

No uploaded documents are shared publicly or with other users. Uploaded files are processed securely and are not used for any purpose other than providing the analysis service and improving platform accuracy.

9. Intellectual Property & Database Rights

All content, data, analysis, software, code, designs, branding, and other materials provided through Estately are the intellectual property of Ether Corporation or our licensors and partners. This includes but is not limited to:

  • The Estately platform, website, application, and API
  • All AI models, deal ratings, financial calculations, valuations, and analytical outputs
  • The aggregated database of auction lots, including its structure, organisation, indexing, and curation
  • Editorial content including guides, articles, market reports, and explanatory text
  • Branding, logos, trade marks, and visual design

Database rights. The Estately database is protected as a database under the Copyright and Rights in Databases Regulations 1997. Ether Corporation has made a substantial investment in obtaining, verifying, presenting, and maintaining the contents of the database, and asserts its sui generis database right against any unauthorised extraction or re-utilisation of the whole or a substantial part of the database, whether evaluated qualitatively or quantitatively. Repeated and systematic extraction of insubstantial parts is also prohibited where it conflicts with normal exploitation of the database or unreasonably prejudices the legitimate interests of Ether Corporation.

Partner and third-party data. The Estately service displays information sourced from third parties including UK property auction houses, HM Land Registry, the Office for National Statistics, Police.uk, the EPC Register, and other data providers. Some of this data is licensed to Ether Corporation under specific commercial terms; some is publicly available under open government licences; and some belongs to our auction house partners and reflects their own listings, photographs, descriptions, and proprietary content. Regardless of source, all such data displayed through Estately is provided to you subject to:

  • The restrictions set out in Sections 5 and 6 of these Terms (no scraping, no AI training, no bulk extraction, no resale, no redistribution)
  • Any additional terms imposed by the original data provider or auction house
  • Any rights of the originating auction house or other partner in their own listings, photographs, descriptions, branding, and materials

You may not extract auction house data, photographs, descriptions, lot details, or any other partner content from Estately for any purpose other than your personal investment research. You may not use Estately as a means to circumvent the terms of service, robots.txt directives, or access controls of any auction house, data provider, or other partner.

Limited licence. Subject to your continued compliance with these Terms, Ether Corporation grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the service for your personal investment research, or for the internal business research of your organisation if you hold a valid paid subscription. This licence does not grant you any right to:

  • Reproduce or distribute the content publicly
  • Use the content commercially beyond your own internal investment decisions
  • Build products, services, datasets, or models based on Estately data or partner data
  • Train, fine-tune, evaluate, or benchmark any AI or machine learning system

All rights not expressly granted to you under these Terms are reserved by Ether Corporation and our licensors.

10. Disclaimers

Estately provides property analysis tools for informational purposes only. We make no guarantees regarding:

  • The accuracy of AI-generated analysis, valuations, or deal ratings
  • The completeness of auction lot data
  • The profitability of any property investment
  • Renovation cost accuracy

You acknowledge that property investment carries inherent risks and that you are solely responsible for your investment decisions. Our analysis should be used as one input among many in your decision-making process.

11. Limitation of Liability

To the maximum extent permitted by UK law, Ether Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to financial losses from investment decisions.

12. Data Protection

Your use of our service is also governed by our Privacy Policy. You may request deletion of your data at any time. See our Data Deletion Policy for details.

13. Termination

We reserve the right to suspend or terminate your account if you violate these terms, with or without notice. You may delete your account at any time by contacting us at [email protected].

The provisions of these Terms relating to intellectual property, database rights, automated access, AI training, partner data, limitations of liability, and governing law shall survive any termination of your account or these Terms.

14. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms. We will notify you of significant changes by email.
